1. Scope of the GTC
1.1 These General Terms and Conditions (GTC) apply to all deliveries and services of Spokes GmbH in connection with the sale and delivery of admission tickets (tickets) and are in addition to other GTC (including house rules). In the event of conflicting GTC, these GTC shall prevail.
1.2 Contractual partner of the buyer and thus user of these GTC is Spokes GmbH (hereinafter "Organizer"). This also applies to tickets sold through authorized presale offices.
2. Order, reduced tickets, validity
2.0 Admission is only possible with a valid ticket. Commercial resale of the purchased ticket is generally prohibited.
2.1 The Organizer does not enter into a contract for the benefit of a child up to the age of 7. Children and adolescents aged 8 up to and including 17 are only admitted to the event when accompanied by a person with parental authority or a person authorized with parental responsibility. A person authorized with parental responsibility is any person over 18 years of age, insofar as they permanently or temporarily take on educational tasks on the basis of an agreement with the person with parental authority, or insofar as they supervise a child or a young person within the framework of training or youth welfare. Persons authorized with parental responsibility must carry written proof of their authorization and present a copy of the ID of the custodial person upon request.
2.2 When purchasing tickets at the box office or at an authorized sales outlet, the purchase contract with the Organizer is concluded by handing over the tickets.
2.3 When ordering through an online booking system of an authorized online ticket seller, the offer for a contract is made by the buyer as soon as he initiates a booking/reservation of a ticket.
2.4 The dispatch of tickets is at the buyer's risk.
2.5 The buyer is obliged to check the confirmation email and the tickets immediately upon receipt for correctness, in particular with regard to quantity, prices, and date.
2.6 The purchase of tickets via the internet is limited to the number of tickets specified by the online shop as the maximum quantity for the respective event.
2.7 Attendance at an event with a reduced-price ticket is only possible if the reason for the reduction still exists at the time of the event and can be proven upon entry. Otherwise, the right to attend the event only exists if the buyer pays the difference between the reduced and the normal ticket price. If the buyer does not pay the difference upon request by the Organizer, section 4.3 applies accordingly.
2.8 The ticket entitles only the authorized holder to a one-time visit to the event location and loses its validity upon leaving it.
3. Shipping conditions
Only the General Terms and Conditions of the authorized presale outlet from which the customer purchases the ticket(s) apply.

5. Exclusion of rights of withdrawal and return in the case of ticket purchases

6. Cancellation of events, allocation of other seats
6.1 If an event is cancelled for reasons attributable to the Organizer, the buyer will receive a refund of the face value of the ticket (excluding presale fees or similar charged by the ticket seller). No further claim for damages exists.
6.2 The Organizer further reserves the right to assign the buyer a seat other than the one indicated on the ticket for the respective event if it is not possible for the Organizer, for reasons beyond its control (e.g. construction work), to make the seat indicated on the ticket available and the replacement seat is comparable. Otherwise, the Organizer must refund the difference to the price indicated on the ticket.
6.3 The Organizer further reserves the right to assign the ticket holder another seat within the confirmed price category for other reasons as well.
6.4 The Organizer reserves the right to change the venue and/or date of the event, provided this is reasonable for the visitor and is announced at least 1 week before the start of the event. Cancellations or changes will be announced by the Organizer as early as possible on its website. No claims of any kind may be derived by the concertgoer from this, unless the Organizer acts with gross negligence or intent.
7. Limitation of liability
7.1 The respective Organizer, its legal representatives, or its agents are only liable in cases of intent or gross negligence. In the event of a breach of essential contractual obligations, liability also exists in the case of simple negligence, but is limited to the foreseeable, typical contractual damage. Claims for damages arising from injury to life, body, or health, as well as under the Product Liability Act, remain unaffected by the above limitations.
7.2 For third-party services (e.g. catering services) and any resulting damages, the Organizer is not liable, but rather the respective service provider directly.
8. Conduct at the event location
8.1 Conduct is subject to the respective house rules, which are posted at the entrances to the venues.
8.2 The house rules and instructions of the security staff must be observed. In the event of non-compliance, immediate expulsion from the venue may be ordered, irrespective of other claims.
9. Audio, photo, and film recordings
9.1 At the event venue, audio, photo, and film recordings are prohibited for copyright reasons. In the event of violations, a contractual penalty is payable, irrespective of further claims, the amount of which is determined at the reasonable discretion of the Organizer, but not exceeding EUR 3,000.00 per individual case. Recording devices and cameras of all kinds may not be taken into the auditorium. They must be handed in at the cloakroom for safekeeping or stored in lockers.
9.2 In the event of violations, the venue staff is entitled to confiscate recording devices and cameras and keep them until the end of the event. Films and recording materials of any kind on which parts of the performance are recorded may be confiscated and stored by the Organizer. They will be returned to the owner once the latter has agreed to the deletion of the recordings.
9.3 The Organizer is entitled, within the framework of the events, to make or have made audio, photo, and film recordings of the ticket holder and his companions, which go beyond the reproduction of a contemporary event (right to one's own image), to reproduce, broadcast, or have reproduced or broadcast, as well as to use or have used in audiovisual media. Consent is expressly given without any claim to remuneration.
10. Applicable law, data protection, place of jurisdiction
10.1 German law applies exclusively. The UN Convention on Contracts for the International Sale of Goods does not apply. Should a clause be invalid, the remaining clauses remain unaffected. The statutory regulation takes the place of the invalid clause.
10.2 All data transmitted by the buyer will be processed by the Organizer in compliance with the applicable data protection regulations.
10.3 If the buyer is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, has no general place of jurisdiction in Germany, or if their residence or habitual abode is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from and in connection with the contractual relationship is Berlin.
